Document intended for professional users of mapage.africa (sellers and cardholders). It supplements the General Terms of Use. The French version is authoritative.

1. Purpose

This agreement governs the processing by MaPage (LAWING TECH) of personal data that the professional User collects from its customers, prospects, and contacts via its card, store, and appointment scheduling. For this data, the professional User is the data controller and MaPage is the data processor, within the meaning of the Digital Code (Law No. 2017-20).

2. Description of processing

  • Nature: hosting of data and provision of tools enabling the professional User to receive appointments, orders, and contact requests.
  • Purpose: to provide the controller with the Service functionalities.
  • Categories of data subjects: customers, prospects, and contacts of the controller.
  • Categories of data: identity, contact details, content of requests, appointments, and orders.
  • Duration: for the duration of the contractual relationship, then deletion or return in accordance with Article 8.

3. Instructions

MaPage processes data solely on documented instructions from the controller, as set out in the Service and this agreement, and not for its own purposes.

4. Confidentiality and security

MaPage ensures that persons authorized to process the data are bound by confidentiality. MaPage implements appropriate technical and organizational measures, including encryption of communications, access control, backups, and privilege limitation.

5. Further subcontractors

The controller authorizes MaPage to use the following further subcontractors: Hostinger (hosting and email, Netherlands) and, where applicable, Mistral AI (European Union) for artificial intelligence functionalities. MaPage informs the controller of any changes and imposes equivalent protection obligations on these subcontractors.

6. Transfers outside Benin

As the further subcontractors mentioned are located in the European Union, certain data may be transferred outside Benin to recipients providing an adequate level of protection, in accordance with the Digital Code and Supplementary Act A/SA.1/01/10 of ECOWAS.

7. Assistance to the controller

MaPage assists the controller, to the extent possible, in responding to requests for exercising data subjects' rights, ensuring the security of processing, and notifying data breaches.

8. Fate of data at the end of the contract

Upon termination of the relationship, MaPage deletes the data or returns it to the controller, at the latter's choice, unless legally required to retain it.

9. Data breach

MaPage notifies the controller, without undue delay after becoming aware of it, of any data breach affecting the data processed on its behalf, along with useful information.

10. Obligations of the controller

The professional User guarantees the legality of the collection, informs its own data subjects, has an appropriate legal basis, and refrains from collecting sensitive data or national identification numbers using the Service.

11. Applicable law

This agreement is governed by the law of the Republic of Benin, in particular Law No. 2017-20 establishing the Digital Code.
